General terms

These terms are intended to provide clarity about trajectories, payments, cancellations, health, privacy and pausing or changing a trajectory.

1. General

PowerVita provides coaching in training, nutrition, lifestyle and personal development. PowerVita is not a medical institution and does not provide medical diagnoses.

By signing up for a PowerVita trajectory, you declare that you have read and agree to these terms.

2. Services and trajectories

PowerVita may offer services including:

The exact content, duration, frequency and price of the trajectory are discussed and confirmed in advance.

3. Registration and confirmation

An intake and registration form gives PowerVita the information needed to start the trajectory properly. A registration is only final after confirmation by PowerVita and clear payment arrangements.

PowerVita reserves the right to refuse a registration if the trajectory does not seem suitable or responsible.

4. Payment

Payment takes place according to the agreed payment method, for example monthly, per trajectory or based on another written agreement.

Invoices may be sent digitally. Payment must be made within the agreed term.

5. Cancelling or rescheduling training sessions

Training sessions must be cancelled or rescheduled at least 24 hours in advance. If cancelled within 24 hours, the session may be charged.

In cases of force majeure, PowerVita may assess whether a suitable solution is possible.

6. Arriving late

If a client arrives late, the missed time is generally deducted from the planned session time. The session ends at the original end time, unless agreed otherwise.

7. Health and personal responsibility

The client is responsible for reporting injuries, pain complaints, medical conditions, medication use or changes in health in time.

PowerVita provides coaching and guidance, but no medical treatment, diagnosis or replacement for care from a doctor, physiotherapist or other healthcare professional.

If there is doubt about health, injuries or training capacity, it is recommended to contact a doctor or qualified healthcare professional first.

8. Pausing a trajectory

In exceptional situations, an ongoing trajectory can be temporarily paused. We call this freezing a trajectory.

This may apply, for example, in cases of:

A pause is always requested in consultation and assessed by PowerVita. The duration of the pause is determined together. In principle, the trajectory is extended by the same period as the pause.

During a pause, no training or active coaching takes place unless agreed otherwise. Pausing a trajectory is intended for exceptional situations and not for structural postponement.

9. Changing a trajectory: upgrading, downgrading or stopping

Upgrading

It is possible to upgrade a trajectory in consultation, for example from 1x per week to 2x per week, or from online coaching to 1-on-1 coaching. The new agreements and rates apply from the moment of change, unless agreed otherwise.

Downgrading

Reducing a trajectory during the agreed term is generally not possible. In exceptional situations, a suitable solution can be discussed.

Stopping early

If a trajectory is ended early, the right to the reduced rate of a longer trajectory may lapse. In that case, the trajectory may be recalculated based on the period actually completed.

Example:
A client chooses a 12-month trajectory with a lower rate per session. If the client wants to stop after 4 months, PowerVita may recalculate the trajectory to the rate that belongs to a shorter trajectory, such as 3 or 6 months. The difference may then still be charged.

10. Privacy and confidentiality

Personal data, intake data, health-related information and other sensitive information are treated confidentially. These data are used only for coaching, guidance, administration, app functionality, payment and safely carrying out the trajectory.

PowerVita does not share this data unnecessarily with third parties. Data may be processed by parties that are needed for the service, administration, payment, technical processing or when legally required. More information is available in the Privacy Policy.

11. Photos, videos and progress material

Photos, videos, measurements and progress material may be used for personal guidance and evaluation of the trajectory.

Use of photos or videos for marketing, social media or public communication only happens with separate and explicit permission from the client.

12. Measurements and evaluations

During a trajectory, measurements may be taken, such as weight, circumference measurements, body fat measurement, progress photos and evaluation conversations.

These data are used to track progress and adjust the trajectory where needed.

13. Final provision

In situations not covered by these terms, a reasonable and suitable solution will be sought in consultation. PowerVita aims for clarity, fairness and personal guidance.
